These Terms and Conditions ("Terms") establish the rules governing your relationship with Magic Mountain Systems LLC ("us," "we," or "our") and your use of our analytics platforms, AI agent systems, and risk management frameworks (the "Service").

Please read these Terms carefully before using the Service. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and anyone else who accesses or uses the Service.

Purchases

To purchase any product or service offered through the Service ("Purchase"), you may be required to provide relevant information including, without limitation, payment details, billing address, and shipping information where applicable.

By submitting a Purchase, you represent and warrant that: (i) you are legally authorized to use any payment method provided; and (ii) all information you supply is accurate, complete, and current.

By submitting your payment and purchase information, you authorize us to share such information with third parties as necessary to process your transaction and create your service account.

We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to, service availability, pricing errors, inaccurate service descriptions, order errors, or suspected fraudulent, unauthorized, or illegal transactions. If your order is cancelled after payment has been processed, a full refund will be issued.

Service Availability, Errors and Inaccuracies

We continuously update and improve our Service offerings. Information on our Service, including pricing, descriptions, and availability, may occasionally be inaccurate, incomplete, or outdated. We are not in a position to guarantee the accuracy or completeness of any information published on the Service.

We reserve the right to update, modify, or correct any information, including prices, descriptions, and availability, at any time and without prior notice.

Subscriptions

Certain portions of the Service are available on a subscription basis ("Subscription"). Subscription fees are charged in advance on a recurring basis ("Billing Cycle"), either monthly or annually depending on the plan you select at purchase.

Your Subscription will automatically renew at the end of each Billing Cycle under the same terms and conditions, unless you cancel prior to renewal or Magic Mountain Systems LLC terminates your Subscription. You may cancel your Subscription renewal at any time through your account management portal or by contacting our support team at dev@magicmountain-systems.com.

A valid payment method is required to maintain your Subscription. You agree to provide accurate and complete billing information, including your full name, address, zip code, telephone number, and valid payment details. By submitting this information, you authorize Magic Mountain Systems LLC to charge all applicable Subscription fees to your designated payment method.

If automatic billing fails for any reason, we will issue an electronic invoice requiring manual payment within a specified deadline corresponding to the applicable billing period.

Fee Changes

Magic Mountain Systems LLC reserves the right to modify Subscription fees at any time at its sole discretion. Fee changes take effect at the end of the then-current Billing Cycle.

We will provide reasonable advance notice of any fee changes, giving you the opportunity to cancel your Subscription before the new pricing takes effect.

Your continued use of the Service following a fee change constitutes your acceptance of the revised Subscription fee.

Delivery of Digital Services

Our analytics, AI agent, and risk management services are delivered digitally. No physical shipping is involved.

Access to purchased digital services will be activated within 24 hours of successful payment confirmation. You will receive a confirmation and access instructions via email upon activation.

Refunds

Refund requests for Subscriptions are evaluated by Magic Mountain Systems LLC on a case-by-case basis at our sole discretion.

A refund may be granted when the Service itself is non-functional due to issues directly attributable to our platform. Compatibility issues or problems caused by third-party systems, tools, or configurations outside our control do not constitute grounds for a refund.

Support

Magic Mountain Systems LLC provides its analytics, AI agent, and risk management services on an "as is" basis. We do not warrant that the Service will function in any particular manner you may expect or that it will be compatible with all third-party systems or components.

Support and updates are provided for active products under active licenses. Magic Mountain Systems LLC reserves the right to discontinue support for any product or service under the following circumstances:

  • The product is no longer actively maintained or developed by Magic Mountain Systems LLC
  • Magic Mountain Systems LLC is acquired by or merged with another entity

While we strive to provide timely and helpful support, we do not guarantee that every support inquiry will be resolved to the complete satisfaction of the requester or within any specific timeframe.

User Accounts

To access certain features of the Service, you may need to create an account. You agree to provide accurate, complete, and current information at all times. Providing false or outdated information constitutes a breach of these Terms and may result in immediate account termination.

Accounts may be created automatically when you request access to a free product or service and submit your information, or when you complete a purchase.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree not to share your password with any third party and to notify us immediately at dev@magicmountain-systems.com if you become aware of any unauthorized access to or use of your account.

You may not use a username that infringes on the rights of another person or entity, is subject to trademark protection belonging to others without proper authorization, or is offensive, vulgar, or obscene.

You have the right to request deletion of your personal data at any time. Please note that we may retain certain data necessary to properly manage and document your purchase history in accordance with applicable legal obligations.

Intellectual Property

All content, features, AI models, and functionality of the Service—including but not limited to software, text, graphics, logos, and AI models—are owned by or licensed to Magic Mountain Systems LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

Limitation of Liability

To the fullest extent permitted by applicable law, Magic Mountain Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
